CT DEEP Serves Notice of Violation

The Aggregate Fill Pile is deemed in violation of multiple statutes by the CT Department of Energy and Environmental Protection (DEEP) in a Notice of Violation (NOV) letter to Julian Enterprises – the contractor running the Aggregate Yard. Among the violations cited were:

  1. Failed to submit for the General permit for the Discharge of Stormwater Associated with Industrial Activity
  2. Failed to prepare and keep onsite a Pollution Prevention Plan
  3. Failed to monitor Stormwater
  4. Failed to maintain adequate sediment and erosion control methods

It should be noted that this notice came a full three years after the contractor occupied the site and that these safeguards should have been in place from the inception of the relationship. No one from the Town’s DPW, Legal, Purchasing or Conservation Departments (all of which ultimately report to First Selectman Tetreau) had checked to determine that the Contractor had obtained the required permits and was performing the required environmental monitoring.
