No Contract is Created. Why?

In violation of the Town Charter this lease wasn’t brought before the requisite town bodies as required. No contract is created between the Town and the contractor despite the potential for environmental and liability issues that could (and have) ensued in an arrangement where a third party is receiving and distributing truckloads of “spoils” that ultimately need to be evaluated for contaminants an a load-by-load basis. The Town Charter stipulates that as part of the Town Attorney’s duties he is to:

“(2) Prepare or review all contracts and other instruments to which the Town is a party or in which it has an interest;”

Why then- when there are compensated employees including a Director of Purchasing, a CFO, a Town Attorney and the First Selectman – was this relationship allowed to be guided by an RFP written by two DPW managers? Why wasn’t an environmental attorney engaged to create a contract that would protect the town, it’s citizens and environment?
